H1B to F1 - Change of status / Urgent Queries

Hi team,

 

I'm planning to convert from H1B to F1 for Master's at reputed university.

 

 

Few questions:

 

1. After the application for CoS is made and approved, will I have time to take 2 weeks for resignation? i.e. will there be a specific time when the F1 will Kick-in or I should quite exactly on the approval date?

 

The reason being, if the F1 starts on date of program start (mentioned in I20) I can quit 2 weeks before and join college a day before.

 

2. Once I get the CoS approved, can I continue with my H1B - just in case if I don't have that breathing space to quit.

1. Probably. There will be a start date when your F1 status becomes active.

Thanks for your response. Although for query 2, let me rephrase - If my F1 is active from 30th of August can I choose to cancel this if I'm not getting 2 weeks to quit ?

 

Not sure If I'm making myself clear, but let me know if you didn't get the query.

When the COS to F1 becomes active, your H1 is gone, and you have to stop working at that date.

To go back to H1, the employer would have to file an H1 petition with COS.

Yes, you would need to exit and enter with a H1B visa and I797 to cancel your COS to F1 and stay on H1B.
