swthme Posted April 20, 2014 Report Share Posted April 20, 2014 We requested extension for my parents 65 days prior to their return date and waiting to hear the decision and their original return date is getting close. My questions are 1. Can they stay beyond their i94 expiry date if the the decision is still 2. If the extension is denied, will their B2 visa become void and do they need to reapply for B2 visa? (There will be 6 years left on the multiple entry B2 visa for them till date). TIA Link to comment

So wanted to take them places and eastcoast, since we live in northwest, we requested extension. If they leave before I94 expiry date and if they got denial, will their visa will stay active and not void? Link to comment

Their visa will stay good if they leave before I94 expiry. Link to comment
t75 Posted April 21, 2014 Report Share Posted April 21, 2014 Poor timing of entry is a really bad reason for an extension. If you wanted to sightsee, they should have planned their visit accordingly. If they leave before receiving a denial, their visa is still good. However, their travel pattern is forever on record and may affect future visas and entry. Link to comment

But it will be good for them if they leave US before I94 expiration. Moreover they have valid visa, so they can visit those places next time. And also plan accordingly, your reason for ext is not much convincing. Link to comment
