Got old i 94 on I 797A form....

Hi,

 

I entered to USA on June 2012 on H4 and got I 94 on H4. I applied H1 in April 2013 and traveled to India in May 2013 when the petition is pending. I entered USA in June 2013.  My h1 b got approved in July 2013 with old I94 ( which i traveled in 2012).  Is this gonna be a issue becuase My H1b is stating the Old I 94  instead of New I94 ?  Am i out of status ?

They have on file with pervious I-94 number when your employer filed for H1B and that's not a valid I-94 number because you have with different new I-94 number.

 

If you want work on H1B you have to attend for stamping.
