Job change after I-140 approval - is Update of Skills & Job Description OK?

Recommended Posts

I have been working  as a contractor for a Client A through a Consulting Firm B for 2-3 years. During this time Firm B filed by I-140 (approved) and recently got my H1b - 3 yr extension(after 6 yrs).

Client A wants to hire me and offered a Senior Software Engineer role (My current role is Software Engineer as per PERM with Firm B).

Main reason they want to hire me is for my niche skills I have developed and used in my project. They want my job description to reflect those unique/niche skills  so it will be easier for them to hire me. The thing is I developed those niche skills after my current employer B filed for my PERM(2yrs ago) and hence were not mentioned in Job Description. But I mentioned them in my I-140 resume.

I heard change in job description is a risk. so just want to know if the following are a risk.

1. Adding addition skills & responsibilities to the ones already mentioned in my original PERM/I-140

2. Change in role from Software Engineer to Senior Software Engineer.

You seem to be very confused about the process. The title change with the same employer may be an issue (and I have seen many case where added Sr. is not an issue), but it is irrelevant if you are changing employers. You will either be filing AC21 or a whole new LC.

Thanks for the info
