H1B- Change Status Denial -MTR

Hello,

 

I have received H1B, but my change of status from student to H1 got denied. The visa granted is only for 1 year..I had two options either go India for stamping or file for MTR-reopen your case. I chose the MTR as their decision of change status denial was based on that I had not submitted all the RFE documents, but in fact I had. The question is -

 

  • How long would it take to receive the response? 
  • While I am waiting for the response, how long can I stay in USA? Is there any time limit ??

please guide me on what should I do now?? Currently I am still maintaining my student status, but I am going to get graduated soon and my I-20 is expiring too.

Hi Guys,

 

I am in exact same situation as my H1 got approved but COS Denied from F1 to H1 reason is not CPT issue actually USCIS did not understand school policy regarding full course of study so its clear case no violation from my end or from school end.

 

I am trying to file MTR (Reopen/reconsider) not appeal. Just want to know how long it take in you case last year to get MTR reopen?

 

Any response will appreciate.
