Can dependent travel on previous employer H4 visa?

Hello- I need an urgent help here,

I was employed with company A. Got extension of visa in June 2012 while we(myself and wife) were in US. We went to india in Jan 2013 and got the visa stamping done(Valid till Dec 2015). I cam to US alone and changed the job in March 2013, now I work for company B.

My wife has to come to US, Can she travel on old company H4? or do i need to file a new H4 through my employer B. Please help.

Thanks, I have 3 questions here now:

1) How do I come to know if my previous employer A has not revoked the H1b petition?

2) How immigration team will know that I am working for company B now, not for A ?

3) Do I need to send just the copy of new employer petition?

Hi Seniors

I have same issue. but My petition is in process . So my spouse can travel to USA on old petition(company A) and I have already joined Company-B.but I did not get petition yet and she will travel within 15 days. and my status showing "in Process" .pls suggest me on this.

Hello Sinha,

My case is also Same.

Recently I changed to company B and Wife and dauther are holding VISA of Company A and they are in india.

They are coming soon...

What happened to ur case?

your wife went to Stamping for Comany B? or had she travelled with the Company A VISA?

please let me know...

If your cap exempt H1B petition with employer B is approved then your wife needs to show at POE her unexpired H4 visa and copy of employer B's I797.

She needs a copy of your current employer's I797 if you are working for them. An offer letter from current employer I believe will not suffice.

Hi,

 

My wife is travelling with old i797, as I am yet to get new i797 copy from new employer. I can only file for h4 extension once I join the new employer. What happens to my wife's status, until the time of preparing documents and filing for an extension with USCIS.

Please help

If you are no longer working for old employer then your wife cannot travel using your old I797. She needs to wait for your new employer's I797 and then travel with a copy of it and a valid H4 visa.

Hi Karthikonh1,

Did your dependents travel safely to US? My case is similar. My dependents have never traveled to US before yet they have old employer name in the visa while I've transferred my visa to another employer. I can provide all valid I797, my I94 and paystubs etc valid till Aug 2016.

H4 has NO CONNECTION to the employer. Her H4 status is ONLY based on your valid H1 status. All she needs is a H4 visa and your latest H1 petition approval for the company you are working for.

Hi...,

Mine is the same case... But in my case the my wife has a valid H4 visa stamped from my ex employer and i changed the employer without getting the approval notice(joined just on receipt). Now she is looking to travel to USA.

 

Will they allow with previous emplyers H4 visa stamped and new company's transfer receipt?

Please help me with this

I see last post in this regard almost an year back, so posting this question to check if there is any change.

I recently changed from Company A to Company B on H1-B. My Wife currently holds a valid H4 VISA stamped through my previous Employer A. My H1-B transfer is still in progress through normal processing. Can she travel with just the receipt copy OR she needs my approved 797 from employer B? Kindly advice
