GC date : Feb 20 2012 I stayed in MA from 2009 to Nov 2016. I moved to CA Dec 1st 2016. I filed my N400 on Jan 5th 2017. I completed my finger prints. I just came to know that I am not eligible to file N400 as I did not stay 3 months before filing is this correct?. what would happen during interview? will the officer accepts the case? or Deny ? please help Link to comment
gc485process Posted July 13, 2017 Report Share Posted July 13, 2017 I am assuming that you got green card under employment based. If so the law states u can file 90 days before 5 years to be eligible. So your case will be denied unfortunately. I am not sure from where you heard of 4 years +1 day even family based by marriage is 3 years you moved to california and then filed right away . You are right you should have resided for atleast 90 days before filing sounds like you should read the instructions of n400 before filing. Wish you luck Link to comment
