cpr_h1
My employer had applied H1b last year which was approved and have got the visa stamping in India itself. I came here couple of months back and my employer was not able to run the pay checks for me and now he is asking to leave the country on top of it he mentioned he will revoke my H1b , My Questions 1) what are the options I have ? 2) What are the odds on my visa status as I have not been issued any pay checks by my current employer 3) I had B2 visting visa earlier , so once my H1b is revoked can I come back to USA any time on that visa for visiting my friends in future. 4) If my employer revokes my current H1b and in future if I find a new employer who can sponsor me H1b visa again Do I need to still go through the old process , ( lottery system) ? 5)How can I file a case on the employer as I have not received any pay checks from him Do I need to get an official confirmation email from my employer stating to leave the country or termination email so that it will be helpful to file a case Link to comment
pontevecchio
If you have the gumption, file a complaint on form WH4 with the federal DOL. Give them all the facts. Even if you paid him for filing mention it. Do not hold anything back. You may revive your H1. Link to comment
