H1 Transfer while I-140 is approved for 6 months

Recommended Posts

Hi - I got my I-140 approved in April 2017. I am completing my 180 days on approved I-140 by October 2017. I am also completing 6 years on H1 by March 2018.

- Can I move to new company in Oct-2017 (once I complete 180 days on I-140)?

- Should my new company get the I-140 approved as well, before I complete 6 years on H1 (ie., Mar 2018)?

- Can my new company submit for H1 tranfer and have validity extended beyond Mar 2018 based on the I-140 that is approved with my current company?

- Anything else I need to take care before I move to new company?

With approved I140 more than 180 days can be used by any employer to extend H1 beyond 6 years even if it is withdrawn after 180 days of approval.

On the same note:  I got my I-140 approved in 2010,  hence crossed the 180 days long before; also crossed 6 years on H1.  When I move to new company, I understand that "With approved I140 more than 180 days can be used by any employer to extend H1 beyond 6 years even if it is withdrawn after 180 days of approval"

Please help me understand:

- New employer (or any employer thereafter) can keep extending my H1 without filing GC?

- If above is true, what should be done when my priority date becomes current?

Thanks in advance!
