I-140 APPLICATION WITH NEGATIVE COMPANY TAX RETURNS

Hi, I have a situation where my PERM Labour is approved 4 months ago. Attorney preparing for I-140 application. But my company's recent tax returns shows negative of $ 64k for the recent year. My attorney feels the I140 application gets denied if we apply with these tax returns. He wants me to wait for another year, redo the PERM labor and apply with new tax returns from next year. My salary is $5000 less than the prevailing wage rate in the past year before my labor was approved. In this situation should i wait for another year or can i file for I140 with the current status. Please advice.

Abhi- I think it better to wait. My I 140 was filled and my salary was $5000 less than prevailing wage and they issue a NOID.

Hi, Do you have any updates on this situation? I have the same issue my company is not sure what to do yet.
