Hi

Firstly, I would like to thank Murthy Law Firm for creating this platform to post my inquiry. Please advise on below

My Current Visa status Background
  • my h1 b started in 2013, Expiry date - 03/10/2018-- (need to file H1 B ext)
  • Green card filing started in 2014 in EB2 with Priority date in Nov, 2014
  • I 140 got approved last year in May 2016 with Company 'A'
  • Currently, I am working for the client 'B' as a contractor through my Company 'A'
  • my wife's H4 EAD started last year oct 2016----- Expiry date - 03/10/2018
  • Need to file for H1 B extension this year in sep  2017 and also for spouse H4 EAD extension same time

Question:

If i take full time with the current client 'B' and i get transfer my H1 B visa from Company 'A' to Company 'B'
(Assuming the new client will start Green card filing next year 2018).

I would like to know the impact on below if i take full time with the client 'B'

  • What is the impact to my existing I 140 with Company 'A' - (I heard as per new I 140 EAD rule- Employer cannot revoke I 140 EAD if it is matured more than 6 months). Please clarify
  • Impact to my spouse H4 EAD status ?
  • Any other implications to my H1 B Visa status?
