saiamit
Hi, First of all, thanks Murthy Law Firm for maintaining such a great platform. Although I found similar topic on the forum but my issue is little different. I am in 4th year on my H1B visa and I have an approved I140(first one) from Employer A with priority date of Dec 6 2016. I have been recently laid off and my last date with Employer A is June 02 2017. I would be short of 4 days to finish 180 days of employment after my I140 approval date. Now I have a potential Employer B who can file H1-B visa. 1. If my new Employer B files H1B transfer, would I be eligible for 3 year extension based on my Employer A’s approved I140? 2. Can my H1B extended for any number of years(in multiples of 3) even when the new employer B do not start my GC process? 3. Say for example, I change my job again and this time to Employer C, can I keep going on extending my H1B based on my first approved I140 until my priority date becomes current without having to re-apply for either of my Perm or I-140 ? Please clarify. Thanks Sai Amit. Link to comment
pontevecchio
1. Yes. It has always been possible in most cases. 2. As of now you can get H1 extensions as long as you have an approved I-140 with any employer. 3. See 2. Link to comment
