Shib Posted May 16, 2017 Report Share Posted May 16, 2017 Hi, I'm in my 6th year, My I-94 is expiring on 6th Oct 2017 (based on pervious employer stamping) current I-797A is expiring on 13 Feb 2018. My perm is approved and company preparing to file I-140. My attorney said that I can get my 1 year ext. on the basis of my approved perm. On the other hand my manager asked me to go to Canada and the get stamping done and get new I-94 with the current I-797. My Question here is will there be any issue if I go for stamping with the current I-797 while my extension petition (on the basis of approved perm) is pending /in process with USCIS.
