I am getting an offer from company Y and they will be filing for my H1B Transfer. Since there is no premium processing for the transfer at this time, the filing is a regular one. The immigration team of company Y says it can take a maximum of 6 months for the transfer petition to get approved, but I can join after receiving the receipt. So if I quit company X and start working for company Y and while my petition is still getting processed (not approved ), can I travel outside the US during this period till my petition is approved ? 1. I might have to very urgently travel outside the US during this period and is there any clause that can allow one to travel under emergency circumstances ? 2. What is the consequence to the visa petition if I travel during this period while the petition is pending approval ? Link to comment
sant2159 Posted May 4, 2017 Report Share Posted May 4, 2017 I am in a very similar issue. Lot of people I've spoken to have said its alright to travel with a H1 transfer receipt with a valid stamp from the previous employer. But, I don't know anyone who has done so! Link to comment
