Visit Germany for a month and come back to USA

Hi, my father is currently in USA on visit visa B1/B2. He has I-94 valid until Sep 1. He would like to visit Germany in the mean time for a month or so and come back to USA and stay until Sep 1 (expiry date of current I-94). He already has visit visa to Germany and that is not an issue.

Does anyone know if my father would have any issue while coming back to USA from Germany? I am worried that the agent at the border might say that my dad doesn't have enough gap between the previous trip and the current trip.

Your father should be able to do so if he can articulate to the CBP Officer that he intends to stay only till September,1 on his return from Germany. A return ticket from here to India on or before September,1 would make it very easy.
