vin4679
I am working for company A and my current H1B and I94 (company A) expires in May 20, 2017. My current employer (Company A) filed H1B extension in Jan 03,2017 and got RFE in Jan 20,2017. RFE responded in April 06,2017 but extension got denied. I would like to know my options. 1. My employer company A wants to file new H1B application before my I94 expires. Can I work after new H1B application filed and after I94 expired? 2. Can I change my employer to company B after I94 expired and new H1B application filed through company A is still pending? Link to comment

Your I-94 needs to be active at the time of transfer. Link to comment
pontevecchio
If B files your H1 petition before May, 20 then you can start working for them on receipt. Is B hypothetical or does it exist? Link to comment
