shir Posted April 18, 2017 Report Share Posted April 18, 2017 Hi, I have applied for H1B visa for 2017, got an RFE and it was replied by first March, and it's status is as since My wife is presently in US on h1b, and I would like to go and visit/stay with her for couple of months on h4. While filling up the ds160 form for H4, it asks about the present employment details. - My employer name would be different in ds160 for H4, than what is mentioned in H1 petition, would this jeopardize either of the application since different employer's involved in both the application. - Do I make my intention clear to the immigration officer that I would be there for just a couple of months and would then come back to my home country. - Is it necessary to get some letters stating that I am going for a long leave or sabatical or leave of pay, etc.. rohang Posted April 18, 2017 Report Share Posted April 18, 2017 you will surely need to get letter/approval from current employer for extended leave. That is one of the must document for H4 interview. it is ok for future employer to file for H1, so no issue thr. Link to comment
pontevecchio Posted April 18, 2017 Report Share Posted April 18, 2017 The only requirement for a H4 visa is the valid H1 status of the spouse and valid marriage. They ask for a job in case you come under the TAL. Otherwise it is NONE of their business, Link to comment

Otherwise it is NONE of their business, Thanks, however if the question comes up about the duration of stay, it's mentioned as 1yr in ds160, however I am not actually decided on the duration, I have put in 1yr as maximum possible stay however it might be just couple of months what may be an appropriate answer?
