H1B transfer as well as extension, which i797 should I use?

Hello everyone,

 

I did an H1B transfer last year (from A to B) and got approved, the validity date for company B on my I797 is till 8/31/2017. Company B also filed an extension in March and it got approved, the new approved I797 is from 9/1/2017- 8/25/2019.

 

I am planning traveling back home and get a visa this summer in 6/28/2017 and return back to U.S. in 8/5/2017. Which I797 receipt number should I use when I file my DS160 form? (I will take both for interview for sure)

 

I know this kind of questions have been asked so many times and I would assume using the new one so that I can get longer visa date (1 year instead of 2 months), but my lawyer said "We recommended using the current approval notice when submitting the DS160 in order to avoid the possibility of the Embassy linking the start date of the new visa to the start date of the current approval notice." I am now super confused. Isn't the start date of new visa the date you have your interview?? how can you get a visa that starts in 9/1 if you have a interview in June???

 

Any suggestions? Experience?

You can use new receipt number. The visa stamp will always have a issue date but not a start date. I did that twice and did not have any issues.
