H1 B Transfer before October 1st

Hi,

My company  X has applied for my H1-B on April 3 2017. The petition start date is October 1 2017. I am currently working with the company X on OPT. I have an offer from company Y on April 10 2017. Employer Y is ready for H1-B transfer.

If my name is picked up in the lottery:
1. Can I change my employer before October 1 2017 ?
2. Can I switch right now ? (Before the results of the lottery are out) ?

My current company X will not revoke or terminate the petition. They are supportive because of XYZ reasons. Pl let me know. Thanks.

A transfer before Oct. 1 is not possible. You have to start working on H1 for the original H1 petitioner before a transfer can be done.

And btw, a company is required BY LAW to inform USCIS if the person is not starting to work there. Are you telling us that the H1 petitioner is going to break the law???
