H4 EAD Renewal with H1B regular extension

Hi,

 I have my I-140 approved, my wife has H4 EAD as well. My current H1B expires on 31st Oct 2017 and with premium processing suspended for 6 months, my employer will apply for H1B and H4 in early May through regular processing. I have below questions regarding my wife's H4 EAD renewal.

1. What is the earliest H4 EAD can be renewed before expiry, is it 120 days or 180 days.

2. Can i apply for H4 EAD renewal with H1B/H4 extension receipt number, or should i wait until my wife's H4 is approved.  

Can you please help me with above questions.

Hi Sumanth,

I am excatly on the same boat as you are. Even my H1b , spouse H4 EAD expires on 31st Oct 2017. We would be applying for H1b extension, H4 and H4 EAD may be by June.

1.Question here is, USCIS recently posted news about auto renewal of H4 EAD for 180 days if filled appropriately. Does this still hold good.

2.My wife is currently working and would she have to stop work , if her H4 EAD is not approved before Oct 31st 2017?

I would request experts here to provide insights on both mine and Sumanth's queries.

My attorney is saying H4-EAD spouse can work during extension(H1+H4+EAD).  I am not sure about it as in Jan, USCIS allowed some categories which doesn't included (c)(26) . I came to murthy forum with the same question.

Can we file H1/H4 and H4 EAD extensions simultaneously

Unfortunately, H4 EAD will not be auto renewed.

For certain categories that are mentioned in the above link, EAD will be automatically extended for 180 days as long as extension is filed under the same category and in timely manner. 

However, H4 EAD is C 26 category and it is not included in auto renewal.

 

Note: I am not a legal expert. Just offering what I read.
