GC Process for spouse of US Citizen

Hi Guys,

I am US Citizen, recently i have got married . My wife is from India. Right now she is in USA on B1/B2 Visa. She came to USA last week. when can i start the process of her Immigration petition(I-130) /I-485 . Do we need wait couple of months (2 to 3 months) to start the process or can we start the process

immediately. what is the best option. Please share your experience or ideas on this. does anyone had similar situation.

You can start as soon as you both register your marriage in USA (may be courthouse marriage) but my question is when you guys married in USA what was your wife status then? H1, L1 or K1?? i would recommend to start process with a good attorney.

Indian marriages remain valid in the USA. The problem is that she has come here on a visit visa which implies she will be back. Should you want to go ahead with filing for her, have a law firm do the paperwork.
