taruBRC Posted March 24, 2017 Report Share Posted March 24, 2017 Hi, here is my situation - i-140 approved with employer A, H1-B valid till sept 2019 wife on h4 and working...EAD valid till sept 2019 scenario 1 same employer A , change of state - - do i have file perm labor again? if yes, - can i retain priority date? - do we need to file for EAD again or she can work on existing permit without any gap scenario 2 employer B, same state and county, - i will have to file perm labor. - can i retain priority date? - do we need to file for EAD again or she can work on existing permit without any gap In general what are the conditions to port priority date ? - job title/responsibilities same as original perm labor? - same job location? Indian_TX Posted April 5, 2017 Report Share Posted April 5, 2017 it doesn't matter, PD can be applied when your new employer files 140 as long as your previous 140 is not revoked due to fraud or mis-representation. Link to comment
