sreesony Posted March 24, 2017 Report Share Posted March 24, 2017 Hi, I worked with my Employe for more than 6 years and got H1b extension for 3 more years based on approved 140. For maternity related reasons, I changed my status to H4 EAD and resigned. I still have 2.5 years of H1b left in my approval notice. 1. If the Employer withdraws the 140 , Will I be able to change status from H4 to H1b in future without being counted against quota ? Thanks in advance. Ps : Based on the Rule published in Jan 17 2017 , The new rule amends existing automatic revocation rules to prevent I-140 petitions that have been approved for 180 days or more from being automatically revoked solely because the employer withdraws the I-140 petition or the employer's business has terminated. These approved I-140 petitions will remain valid for certain H-1B extensions; Link to comment
