aishuuu143 Posted March 24, 2017 Report Share Posted March 24, 2017 Hi, I did a H1 transfer from company 'A' to company 'B' while I was in a project but my payroll was running with company 'A'. After my H1 transfer with company 'B', I got the visa valid until 2019 (as the company B has shared the I797C, in which the status shows as approved) but I recently had a vacation plan and traveled out of the country and now my I94 date has moved to 2017 as my stamping date was expiring by 2017. Now my current company 'A' has revoked my H1B petition and my new assignment with company 'B' has not yet started. Please advise if I am in status legally and how many days can I stay without my payroll run? Thanks in Advance. Link to comment
Don'tAbuseVisa's Posted April 18, 2017 Report Share Posted April 18, 2017 Nope, you can't stay without payroll, Employer A did as per legal, company has to inform USCIS once you are no longer with them. Now you have to get paid by company B (even if you are on bench) and run payroll and then find some real company to transfer. Get help from murthy attorney's. Link to comment
