gforce211 Posted March 22, 2017 Report Share Posted March 22, 2017 Hi all, I just received an audit notification for my PERM application filed on Nov 21, 2016. My H1B visa expires in September 2017 (6 years). My lawyer informed me that I would have to leave the country in September and then wait until my PERM is approved, I-140 is filed and subsequently the H1B extension is approved. This process would take in excess of 10 months. What are my alternatives to continue my stay? 1. Can I switch back to an F1 visa and continue working on CPT? 2. Would it be challenging to return back to the country once I leave? Link to comment
