GreenCardDoctor
Hi I am a H1b physician married to a J1 physician (subject to 212(e). I am planning to file for an EB1A Green Card and all my paperwork is ready. My wife will apply for a waiver in about 4-5 years but can't do it before that due to ongoing training. Will she run into issues renewing her J1 visa or traveling if she is listed on my I-140, as that shows immigrant intent? Obviously, she is not eligible to file I485 at this time until she obtains her waiver. Any advice is appreciated. Link to comment
pontevecchio
You should consult a lawyer about the best way to approach the matter. There are different ways of getting a waiver. Link to comment
care_candidate
Why don't she consider using conrad-30 and work in underserved area? After she finishes 2 year rule, she can either join you as family or start own EB application. Link to comment
