Urgent help - H1B beyond 6 years

Hi All,

My PERM was filled on 9/30/2016 but I received audit . Attorney will be submitting the audit response soon but I see the current audit response processing time is 7-8 months . I am worried what if my H1B expires before I get the result. My 6th year of H1B end date is 9/29/2017 .

I'm aware of the 365 day rule that if the Labor is filled 365 days prior to the 6th years then I can get one year H1B renewal . So Am I missing just one day or Am I still eligible to get one year  extension ?
