Found another FT job and new employer already filed H1B premium based on approved I-140 but will start GC process ONLY after 18 months(non-negotiable). Question is in the below scenarios what are my options and things I need to be concerned about1. If I get laid off before(with in 18 months) GC Process starts.2. If I get laid off during GC process e.g. 3rd year and new I-140 approval is still pending Link to comment
pontevecchio Posted February 16, 2017 Report Share Posted February 16, 2017 I would suggest taking things as they come. If you get laid off the remainder of the H1 petition approval with this new employer may be available to you. Ultimately you need the job for which an I-140 was filed available at some point of time.
