Perm denied and repealed..H1 extension possible?

Hi,

My perm was denied by DOL stating some information is missing in minimum Job requirements.The information was given though.Lawyers mentioned that there was a mandate not to deny on basis of this reason and have repealed the petition to DOL.My H1B period is expiring this  April.

1) How many days does it take to hear back from them about the appeal ?

2)Considering I have a tight timeline and may not get reply by that date,can my employer file for 1 year H1B extension? Please note that my petition was not put in 365 days prior to expiration of H1 visa.
