I am on H1B for more than 6 years in U.S.A with I 140 approved and waiting for my date to be current and my wife in on H4 EAD. Q1: If i transfer my H1B to another employer porting my previous date, i think i need to file again my LCA and Perm from new employer provided my H1B got approved in premium. While my LCA/Perm is in process with the new employer will my wife still be on H4 EAD and eligible to work ?? As I am already in U.S.A on H1B with the previous employer for more than 6 years, and after transferring my H1B to another Employer with the approved H1B petition, will she be still on H4 EAD or have to wait until my I 140 petition with my new Employer gets approved ??
