Zubeir Posted January 11, 2017 Report Share Posted January 11, 2017 Our Case: My wife is on H1 and filled for EB3. Her I-140 is approved and her Priority Date is Dec 2016. I am on L1A and my employer is planning to file my GC under EB1 around May 2017. Question: When can she file for I-485 and include me as dependent and will there be any problem if she will include me in her 485 while I am planning on starting my own application? Link to comment
JoeF Posted January 11, 2017 Report Share Posted January 11, 2017 A dependent is never "included." When the PD is current, both the primary applicant and the dependent can file individual I-485s. Check the monthly Visa Bulletin for the PDs. Link to comment

Zubeir Posted January 23, 2017 Author Report Share Posted January 23, 2017 I came to US on L1B (Blanket), Jul 2011 and switched to L1A (Individual) on March 2016 (same company, same client) Am I eligible to file my GC under EB1 category or coming to US under L1B can put my eligibility under EB2?
