Hello ,

Need suggestion from experts.

I transfered h1 from company A to B in sep 2016.Company A revoked my H1 in oct 2016 that was valid till may 2017.I got an RFE my employer replied for that RFE ,But My case was Denied in Dec 2016 .

Reason saying that client changed when replying the RFE,Says file new LCA .Now same employer filed again ,but my I94 is not valid now.My I-140 is in process now from 4 months, which is my old priority date is current now.

 

question is which is the best option if my case denied again.

convert my 140 into premium ,if I  got RFE again for H1?

 

In case I need to go back India, what is the best way to do for my green card which is current priority date (converted EB3 to EB2 ,priority date july 2007).
