kalepugirish Posted December 7, 2016 Report Share Posted December 7, 2016 The DOL is improperly implying the years of experience requirement on the application to apply to the skills required in Section H.14. Therefore, the DOL has indicated that you do not have the full 60 months of experience in each of the skills. I heard BALCA recently issued a decision on this very issue and stated that this is an improper basis for denial. BALCA indicated that the DOL should not imply the years of experience to the skills required, as that is not in line with the purpose of the form, or the true requirements of the employer. This case was very recently decided, so it is likely that the DOL officer adjudicating your case had issued this decision before receiving the updated instructions from BALCA . Will my MTR filed ruleover the decision on denail and approve my case? Link to comment
