GC_Visa Posted September 30, 2016 Report Share Posted September 30, 2016 Started working in US for my employer this year, have worked with him earlier in India for about 7 years. Currently on H1B but my spouse cannot work since she is on dependent visa. Have 2 ways : Either start GC process and wait for 2 years to get EAD or get L1B and spouse gets EAD in 6-8 months. What should be done and what are the risks involved ? Priority is spouse starts working asap. Have good visibility of the product I am working on so do not see any issue on that front. But still if needed can I get changed to H1B status if and when required ? Link to comment
vincentanand Posted October 1, 2016 Report Share Posted October 1, 2016 H1B is better than L1. More people are waiting to get H1B. You should be lucky to get H1B. H1B can be extended beyond max out of 6 years, provided you have GC filed and I140 approved. L1B cannot be extended beyond its max out of 5 years. if your spouse wants to work, apply for H1B in next year April. Also apply for GC and if you do I140 in premium processing, you may get it a year and get EAD in next 2 months. That will be the better way. Link to comment
