Jeny Posted September 24, 2016 Report Share Posted September 24, 2016 I am on H1B visa and have my I-140 approved. My spouse completed 7 years in the USA (Max stay) on L1A visa in May 2016. He left to india in May 2016 and got his H4 visa. If he comes back to the USA on H4 visa by November 2016 and gets his H4 EAD and starts working, will he be eligible to apply for a new H1B visa in April 2017? Or will the clock be not reset until he physically completes one year stay outside the USA?? Link to comment
pontevecchio Posted September 25, 2016 Report Share Posted September 25, 2016 The clock is reset by leaving for one year and THEN applying for the H1 through a sponsor. He can work on H4 EAD. He can return after next may in L1 status should his company send him. Link to comment
