RaviGanesh
Hello,My I-140 has been filed in July 2016 and is in pending status. I want to switch to a new employer. Do I need to change the employer only after getting my I-140 approved ? Please let me know what is the advantage of doing that ? If I change employer before I-140 is approved, then do I have to start again from the PERM process ?Please help me on this. Thank you. Link to comment
JoeF
In either case the new employer would have to start the process from scratch. The only advantage of having an approved I-140 is that the PD can be reused. Link to comment

Hi Joe, i have few questions related i140. 1.What happens if the H1 transfer to new employer is approved and i140 is pending , is it an automatic cancelation or employer has to withdraw the petition? 2. if the i140 is approved and after i move to new employer , can i still apply EAD for my Spouse who is on H4? 3. After the H1 transfer is approved , im i immediately considered an employee of the new employer ? what happens to the old H1 petition after transfer.(before joining the new employer). Link to comment
