My spouse is on H4 and I am on H1b (in Texas).

She has a H1b petition from a consultant  (filed in 2014 when we were in our native country India). Now she want to start working for same consultant using same petition (filed in 2014).

What are the options to move from H4 status to H1b status

  • Get stamping done from Mexico
  • Get stamping done from Canada
  • Get stamping done from india  (it might not work as it is going to take 4 months because of queue ) and no client waits for it after selecting a candidate for project/assignment
  • What are the other options?

And which is one is good, correct and easy ?

Note : Till date H1b stamping not done, only petition got selected in lottery and approved in 2014

After surfing through the forum, I got to know there are two options

1) Go for H4 --> H1b COS approval while staying in US

2)Stamping to near by country (though not recommended for first time H1b stamping)

I have one more question : If suppose the approved petition (approved in 2014) is EXPIRED by now, will the option 1 still works ?

Please advise
