Parents Visitor Visa Denied

Hi,

 

I am in USA with H1B Visa and applied tourist VISA for my parents to come and meet me. This will be the first time they will be coming here. But unfortunately there VISA was rejected last week in Kolkata with the reason as 214(b) -  not enough financial or family ties to come back to India

 

We are planning to reapply for Tourist VISA for my parents once again. Can you please help me out with the below questions

1. If I reapply within 2 weeks will that be a negative factor while considering their application

2. My father is a businessman but doesn't ear much hence I am sponsoring there visit. I hava already provided all the necessary documents. In the first attempt we didn't had any proper TAX document to show hence mentioned low value(around 10k) in his monthly income. This time we are planning to give proper documentation and consulting with a CA to have a balance sheet as well. The official income will come around 25k-30k per month. Will this increase in the amount of monthly income at a gap of 2 weeks be a negative factor ? Any help in how to explain this increase in monthly income ?

3. My mother is a house-wife. My father doesn't own any flat/house but has some land by his name. But he don't get any income from them. Can he show them as potential asset ? 

4. My parents wanted to stay in USA only for 5 weeks and accordingly there tickets are also booked. Can they mention that while filling up the DS-160 ?

5. Please note that I am the only child. In that case can they show pics of other family members gathered during different social function to prove that they have a strong family bond back in India.

 

This is bit urgent and any quick response will be immensely appreciated.

Your parents should prove that they have enough money for the trip, not you. So they should sponsor themselves for the trip. By you provide the financial assistance it indicates that they are dependent on you and vo thinks that your parents may not come back since you their only child and dependent on you. Did you get my point?

First off, you don't apply for a visitor visa, they apply.

Second, there is no sponsorship for a visitor visa. You can pay for their trip, but that isn't sponsorship.

Third, reapplying within 2 weeks won't work. Why didn't they have the documents with them the first time around? This looks as if the documents are fake.

They need to show real ties to their home country, not magically providing documents they didn't have 2 weeks earlier.

By Sponsoring I mean to say that I am bearing the cost of there travel as well as the cost of stay in USA. I think there is a clause in the VISA approval process where they want to know if somebody is sponsoring the trip. That should mean that they expect in some cases the trip of an individual is being sponsored by some family member if not friend. Being a son I believe it's quite common that I can gift my parents that opportunity to visit USA like thousands out there. As for there financial ties my father is about to present the details of his business return and the papers of the land owned by him. Please let me know if there is a gap in my understanding

First time we didn't have the required documents from the CA/Tax officer, as that was still in process of preparation and hence we went like that. But this time we have the proper documents to explain the monthly income. Apart from that as I mentioned there are details of the land owned by my father. Apart from that I have also suggested them to carry along photos of other family members during different family functions and get together. I am not sure what else needs to be there to prove strong ties to home country. Can you please suggest me anything else which might help. Thanks in advance.

As I said before, reapplying after 2 weeks is unlikely to work.

And nobody will believe that the documents "were still in the process of preparation."

Further, again, where is the "we went" coming from? You are not involved in the application.

And stuff like photos from past family events is irrelevant. What is needed is evidence of ties to the home country, evidence that they will return.

While somebody in the US paying for the trip is not unusual, it can be seen as a sign that they petitioner doesn't have strong ties to the home country since the petitioner doesn't seem to have much liquid cash. Not having the appropriate financial documents when first applying also indicates that.

They need to address the real issue, the lack of ties to the home country, not appearing so desperate that they apply two weeks later with documents that magically showed up within 2 weeks.

And you should stop trying to coach them. Coaching is easily detected, and is also a negative when evaluating the application.

 I am here in USA with my wife on H1B visa since 2011.My parents applied visitor visa for 3 times and every time they got rejection. I even tried with Letter of Support from senator, but still no success. I think every time they (Visa officers) just refer the previous decision while making decision for current application. Now I am ran out of options. I don't have any idea to improve my parents visa application. Any suggestion from you is appreciable.
