rajasanjeevkumar Posted August 18, 2016 Report Share Posted August 18, 2016 Hi, I have done MS in USA from 2006 to 2007 and I got H1b approved from 2008 to 2011 under Master's(STEM) quota. I only worked for 4 months in this visa and I went out of USA. I came back to USA in 2014, starting working using L2 EAD and got cap-exempt(non profit) H1B approved. I am currently working on this H1B visa. Recently, I got an offer from a for profit company and I wanted to transfer my old for-profit H1B to the new company. However, since it has been more than six years(from 2008), my new company's immigration specialist is saying h1b transfer is not possible. Can you please advise? PS: I have already paid for single time consultation with Murthy firm and the attorney said this shouldn't be a problem in 90% of the cases. Thank you very much, Raja Link to comment
pontevecchio Posted August 19, 2016 Report Share Posted August 19, 2016 How do you expect a forum run by the Murthy firm to second guess a Lawyer from the firm?. As they pointed out it is possible though dependent on the whim of some Officers. Link to comment

If yes, I want to find out what document is missing from my profile. If I can show a memo or written law or some other thing which will convince my employer, I can improve my chances. Link to comment
rajasanjeevkumar Posted August 23, 2016 Author Report Share Posted August 23, 2016 My employer's immigration company didn't file for h1b transfer saying even it is done, if USCIS figures out this error in the future, it will jeopardize my green card process. My employer also agreed with their immigration specialist that it is risky and could hurt their reputation. Link to comment
