veeraraghavant Posted July 25, 2016 Report Share Posted July 25, 2016 Hi I have been working for my employer A for the past 7 Yrs. Thru him, I got H1B Visa and got few opportunities to work in USA. Even though it was not continuous journey, I spent close to 4 yrs overall out of 6 yrs quota. I got relocated to India last year and have spent almost 1 year working in managerial/ Supervisor role in India. I have questions with respect to L1A-individual visa. Technically is it possible to raise a request for L1A-Individual at this point by my current employer ? The reason for asking is that I have close to 2 years remaining/ left over from H1B Visa. 1) Will USCIS accept by new L1A Ind visa ? 2) Will USCIS reject L1A Ind stating that H1B is still alive and ask me to finish off the remaining H1B quota (close to 2 years) ? 3) Incase if USCIS accepts my L1-Ind request, will they give me fresh 7 years of visa (or) just 2 years ( re-captured from current H1B Visa) ? pontevecchio Posted July 25, 2016 Report Share Posted July 25, 2016 The H1 and L1 have no connection. If you qualify and the employer files L1A and gets it approved after you have spent one year or more away from here, you will be entitled to a total of 7 years. Link to comment
