subbuvenky
My parents GC got approved 2 weeks back and would like to know the limitation of their travel outside the country and how is it being calculated if its limited to 180 days time. 1. Can they travel outside the country in 12 months period? 2. Can they stay more than 180 days in a single trip or can this be done on a special reason like medical condition or family function sort of thing? 3. If the limit is 180 days in 12 months period then how is it really calculated. In any point in time if we take 12 months time frame their stay could not be more than 180 days or its based on a calendar year? 4. They are planning to leave end of July 2016, Come back in Feb 2017 and again go for couple of months in June 2017. Will this be ok? Please provide your input. Thank you all and appreciate your help. sindolik
I have same exact question. Did you get answer? Link to comment
pontevecchio
GC means they reside here permanently and pay tax on worldwide income subject to national treaties. They also need paid Health Insurance. Generally periods of 6 months of travel or less do not affect the GC. More than 6 months MAY need an explanation which is accepted. More than one years stay may nullify the GC. Past results do not guarantee the same performance nowadays. If a longer stay is involved please have them discuss the issues with a Lawyer. sindolik
But what about situation outlined above? Link to comment
JoeF
This is not based on calendar year. The duration of each trip matters. Link to comment
pontevecchio
One does not make the rules. Any stay of up to 6 months is fine. More than that it depends on the circumstances and making predetermined decisions is a bad move . Link to comment
cap-gap
going on extended absence just a month after getting GC followed by a pretense stay of month for a repetitive cycle is clear red flag.. though the enforcement is not as stringent as non immigrant cases, you just have to take your chances and see..
