I have an approved I-140 (PD: March 2013) and my H-1B will be expiring in Sept 2017. I still have almost 6 months to go before my company files for my H-1B extn again based on AC21. My question is - I plan to change my job as soon as my H-1B extn comes in. Assuming that my current company retains my approved I-140, what all factors do I need to work on for smooth transition to the new company and retain my current Priority Date? Thanks in advance! NP2020 Posted September 29, 2016 Report Share Posted September 29, 2016 Your transfer process should be normal. Even if your I140 is revoked by employer who filed it, it wont impact your priority date unless revoked for fraud. If I140 is revoked, only caveat I see is that you wont get 3 year extensions if you plan to change employer again. Link to comment
