DS160--> interview or some other way? I539 should be filed only if that person is inside the US. There is no COS if you are outside the US. Link to comment

pontevecchio Posted June 30, 2016 Report Share Posted June 30, 2016 1. one can change status from H1 to H4 if one qualifies and this implies being in the USA. 2. One can apply for the H4 visa if abroad and get it based on the valid H1 status of the spouse. COS ONLY applies here. Link to comment
JoeF Posted June 30, 2016 Report Share Posted June 30, 2016 A COS (Change of Status) is only done while in the US, because by definition you only have a status while in the US. If you are outside the US, you can't use the I-539. You can apply for an H4 visa at the consulate with the DS-160. Link to comment
