It has now been rejected 4 times and every time the reason given was 214(b): "not enough strong ties to the home country" - when in fact VO never asked any questions that would give my parents the chance to demonstrate strong ties to our home country. I have two siblings both unammaried, Grand parents and they all live together. All my relatives are based out in India. I am only one in the US.First time my parents applied in May 2010Second Time: 2011Third Time: 2011Fourth Time: 2016In between they been to UAT-Dubai once in 2013First Interview Expierience:VO: Why you want to go to the USAns: TourismVO: Do you have any relatives in USAns: Elder SonVO: What does he doAns: Software Programmer with XYZ companyVO: How long you intend to stay thereAns: 4 monthsVO: What do you do hereAns: BusinessVO: Who is going to look after the business in your absenceAns: Father and youger brotherThat's it...this triggered the rejectionAfter this experience they kept on denying every time my parents went for the interview and never bothered to ask questions that would enable my parents to demonstrate strong ties back to home country...it was clearly evident that they were pre-occupied with their mindset for the denial - otherwise how on earth would a VO be able to come to such conclusion based on mere basic questions like: Why you want to go, who is in the US?, what do you do here?Can somebody please help here on what went wrong and if we can reapply right away just to show the VO that the intention is not to work in the US/or not come back to the home country and you have been denying the visas merely based on the basic questions without giving any chance to prove otherwise Link to comment

But I have also read it that contacting attorneys not gonna help by any means...I mean my parents' case is very genuine. they have absolutely strong ties back in India...the problem is VO is not even ready to look at the documents or ask them the questions so that they can prove it...how would you prove your ties if you are merely asked basic questions everytime? pontevecchio Posted June 30, 2016 Report Share Posted June 30, 2016 If you are going to take the help of an unknown person on a forum as opposed to sage guidance by a law firm who has dealt with this situation before, I wish you the best of luck. Frequent responders here are not a substitute for professional help. In your parents case something they were coached to say during the first interview has been noted down. It could also be a function of your H1 credibility. I will always guide people to a Lawyer where appropriate irrespective of what posters feel. Link to comment

I am not saying somebody who has a business and is leaving for 4 months should be granted visa. My problem is not with the 1st denail. My problem is with the subsequent rejections based on the 1st interview that was 6 years ago and they have used the same reason to deny everytime from there on without even giving my parents a chance to demonstrate "strong ties" to home country. If they want to reject it everytime citing the same reason, then they should also give chance to prove something. Not like ask basic questions and reject it. It's not that we have re-opened the case or have askedthem to reconsider the case. Every attempt is a separate attempt that requies Visa fees to apply. Link to comment

They have discretionary powers and do what they do, most likely because they have seen all the excuses lots of times before. Oh, and "basic questions" may often be enough to determine if a person has been coached. How a person answers changes when the person is coached.
