Hi All,

My employer applied for H1-B amendment and got the email upon approval with below information.

Classification: H1B
Starting Validity Date: 09/08/15
Ending Validity Date: 09/07/16
Consulate notified (if applicable): CHENNAI
I-94 # (if applicable): with my valid I-94 number - same number as my previous I-797B.

But, I-797B(bottom of page1)is not updated with I-94 information instead It has Receipt #:, Notidate Date, Case Type, Petitioner, ...Consulate information.

My attorney and employer overlooked this error.

One of my friend who has knowledge on these, told me that The above information is printed by mistakenly instead  of I-94 info. Since, Approval email has the valid I-94 number. Also, suggested us to write an email to processing center which they provided in email for the revised copy with i-94 information before going for amendment/extension.

But, My Employer said that they will file the Extension with existing copy and then provide this information if they put RFE.

I need expert inputs on my case. Please suggest me the correct way to rectify this issue ASAP.

Thanks in Advance

I have similar issue. I got i797 B approval notice for 3 years, but with no extension of i 94. My i 94 date expired along with my first H1 09/22/2016.

Do i need to get stamping done asap?

If so how soon i have to get it done and which place is suggested (other than india as slots are full).

Please suggest.

Thanks

Aliya

Yes you need VISA asap. If you doesn't have a valid I94 currently, then you're considered out of status.
