subbuvenky
Parents are in US on B1/B2 visa and have valid I94 until July 2016. Filed their AOS and Advance Parole application April 2016. Had their Finger print done by mid May 2016. No updates since then. Questions: Can my parents stay in US even after their I-94 expires? Any application needs to be submitted for their extended stay if GC not approved by July? Can we call USCIS and request for a advance parole after XX days has passed since the application was made? Can they also travel to another country (as tourist) which was not mentioned while submitting the advance parole application? On your opinion how long would it take for them to get their GC approved with current processing time? Link to comment
pontevecchio
1. Yes 2. No 3. Why did you not file concurrently? If you did the AP/EAD should arrive within a couple of months. 4. They should not travel without valid AP. 5. Maybe 6 months or sooner. Link to comment
subbuvenky
Thank you so much for the response. It really helps a lot. We filed the AP and AOS together but did not apply for EAD as we thought it might not be necessary as the whole GC process might take only around 6 months. Link to comment
