Visa Denied/ Case sent back to USCIS/USCIS reaffirmed the approval

Hi- I got my visa denied in january 2011, i had EVC model. Case was sent back to USCIS for review.

Jonied new employer and now have an EC model, and new H1b visa petition is pending with USCIS.

Now, for my denied H1B petition, there is a status update on USCIS website- we mailed a notice to you reaffirming the approval of this case and returned the case to the Department of State for visa processing.

Please let meknow if anybody has a similar case, or atleast uscis has reaffirmed their approval on denied visa. I want to know if anybody has figured out the next step.

Was ur petition returned from Mumbai consulate?
I believe you can go with reaffirmed petition and attend an interview , You will definitely get the VISA

Can you post exact details of your case with dates?
Also mention if you got blue slips or yellow slips and which USCIS service center reaffirmed your petition?

Model EVC
Visa interview- 1/11/11
Green 221g issued same day, No documents asked.
Visa denied: 1/19/2011, but letter received 3 weeks later.
Changed employer.
Now EC model, working for the same client, new H1B pending with USCIS.
USCIS status changed on denied visa: 23 may 2011, with the message "Petition reaffirmed and case sent back to DOS for visa processing". My petition was filed with Vermon Svc center, I believe its them who reaffirmed it.

Hi,

Did your first employer received any RFE on your denied VISA....

I just want to confirm whethere USCIS re affirmed your H1b after receiving any explanation from your employer or did they just re affirmed it.

No, my employer did not get any RFE. I just saw status changed at uscis website, spoke to my employer and they will forward me reaffirmed I797 once they receive it.

Someone seeking assistance with resolution of an H1B petition pending at USCIS upon return from a consulate may be able to resolve the matter with intervention / assistance from the CIS Ombudsman's office.

I can provide this information to my company's attorney.

My company had contacted murthy law firm and you folks suggested an H1B Amendment. THat is pending as well.

I am also in similar situation, my visa got denied, sent back to USCIS and got reaffirmed. I don't know what will be the next step for visa stamping. Did you schedule new visa appointment? or how you are going forward. Please share information if any.

@Victim_221G Consulate might not contact you. You have to contact consulate with new 797. I already contacted consulate and they said that once you have reaffirmed 797 you can come for the interview. No need for the appointment or HDFC receipts. But it seems that reaffirmed 797 taking forever (3 weeks passed)

I got my Reaffirmed document, also contacted the consulate. They asked for copy of reaffirmed document for PIMS verification. I sent the document waiting for reply from consulate.

Visa Rejection date: Nov 16, 2010
Case sent back to USCIS as per letter from Consulate
Received letter from USCIS to employer: don't know(NOIR/NOID) 10th April
Document submitted to USCIS: 5th May 11
Got reaffirmed of petition on : 27th May'11
Employer Received Reaffirmed document on : 3rd June'11

I just want to weigh in all factors, as i am not working and what happens if Memo quotes E-E relationship. Can we still provide evidence to them?
