srv008 Posted June 15, 2016 Report Share Posted June 15, 2016 Hi all, Need an advice on my current situation. I was on H1 through employer A and took up a job with employer B. I had a vacation planned and my new employer is okay with it. It was agreed that I will resign my job from emploter A after my vacation and join Employer B. Visa transfer was initiated immediately and was approved before I went for vacation. I travelled to India and came back with my old H1. I Never disclosed about the new petition/approval anywhere. My concern here is that my I-94 expiry was determined by my old H1 and it is nowhere related to my new H1. Since I changed the employer, would that be a problem? Do post your ideas. Thank you. JoeF Posted June 21, 2016 Report Share Posted June 21, 2016 If you entered and didn't work for the old employer the damage is done already. The "corrective action" would have been to educate yourself before doing such a foolish thing. Too late now. First, leave the country, then, find a real employer, not a fraud like your current one who suggested this stuff. And you can expect scrutiny of future applications, so everything needs to be by the book from now on. No shady consulting companies, no shortcuts. Link to comment

Neither of my employers(current/past) are consultancies. This is an honest mistake and I am not backing off to face the consequences. I am waiting for opinion from my HR/legal department and will proceed as per their directions. Meanwhile, I am doing some research on my own.. Thanks, Link to comment
