Was deported from US Jan 2012 on an expired (May 2010 18 months) Visitor Waiver visa. Currently in Canada under a Canadian Work and Study permit exp 2018 Has bench warrant issued in CA in 2011 for DUI -working that issue now. Should be dismissed or turned into Conditional Probation for 3 years. Has an assault charge in Canada. Case is closed. Marriage is in separation status. She fears for her safety as her husband is violent and has documented history of physical spouse abuse. She lives barely on money she is given by husband. She has zero extra money. Can she get into USA on an emergency visa of some sort? IF not, assuming #4 is resolved either way, what visa can she apply for to travel to USA? Will item #4 if ‘Conditional Probation’ stop reentry into Canada? Will form I-212 need to be submitted? Link to comment
cap-gap Posted June 15, 2016 Report Share Posted June 15, 2016 why does "she" wanna enter in to US..was there no 5 year ban imposed when deported... too many red flags in the case and should be discussed with lawyer ..if safety is the reason, she can approach canadian police or go to back to UK.. JoeF Posted June 15, 2016 Report Share Posted June 15, 2016 If she overstayed for 18 months, there is a 10-year ban. She won't be able to enter the US until the ban is over. If she has issues with her husband, there are shelters for abused women in Canada. And she may be able to seek the help of the UK Embassy. Link to comment
