Somesh99 Posted June 8, 2016 Report Share Posted June 8, 2016 Hi, When an employee is in 4th year of H1B gets laidoff/fired by Employer A, Can an Employer B file for his/her labor process immediately ? or is there any mandatory wait time for Employer B to file labor for that employee? NP2020 Posted June 10, 2016 Report Share Posted June 10, 2016 First things first: make sure new employer B transfers your H1 so that status remains legal. New employer B can file Perm immediately but usually this is not the case. New employer takes few months to prepare your GC case. Link to comment
